District Court* District Court Judge sits alone to determine sentence. Usually a jury will determine the facts in a District Court trial - although note that there is capacity now for judge-alone trials.
* The District Court has jurisdiction over all indictable offences (s 60 District Court of Queensland Act) EXCEPT: * Section 61(1): Not generally for offences with maximum of more than 20 years UNLESS: * The offence falls within s61(2)(a) or (b) * Note in some instances the District Court can hear simple offences if they have been transmitted via s 651 Criminal Code. * Permanent judges in Brisbane, Ipswich, Beenleigh, Southport, Maroochydore, Rockhampton, Townsville, Cairns, circuits to other areas. * Sits in appellate jurisdiction over some Magistrates Court matters (s 222 Justices Act) |
