Full hand up/paper committal
Where written statements are tendered by the prosecution a committal must proceed by way of full hand up (i.e. not requiring witnesses to appear and give evidence): s 110A(3) Justices Act 1886 (Qld). There is an exception where the defendant is not legally represented: s 110A(4) Justices Act 1886 (Qld). Defence can concede a prima facie case or require examination of the evidence by the Magistrate to determine whether the case is sufficient.
