Force used in execution of powers
Must be reasonably necessary to exercise power: s 615 Police Powers and Responsibilities Act (2000). (Handcuffing may exceed what is reasonably necessary: R v Hardy [2010] QCA 28.)
BUT NOT force likely to cause GBH or death (s 615(3)) UNLESS it is a critical situation under s 616. That is, where the offender is/has or will committ an offence punishable by life, where reasonable suspicion that offender is doing/or is about to do something likely to cause GBH/death to another AND the officer reasonably suspects no other way to stop them. However, must first, if practicable, call upon the person first to stop (s 616(5)).
